Partner Migration
Spouse, Prospective Marriage(Fiance) and Interdependency Applications
If you wish to apply for
- a Spouse/De Facto Spouse visa (Subclass 309/100) or
- a Prospective Marriage visa (Subclass 300) or
- an Interdependency visa (Subclass 310/110)
you should first read the relevant Partner Migration booklet, available for download or purchase from the Australian Embassy.

To make a visa application at the Australian Embassy Seoul, you will need to lodge the application form, pay the applicable visa application charge and lodge the documents listed below (by mail or in person).
Please note:
- All documents must be certified copies of originals (ie certified by notary public/Justice of the Peace), except where stated that the original document is required, and must be accompanied by an official English translation.
Requirement Checklist:
- Application Form 47SP, Application for migration to Australia by a Partner and Form 40SP, Sponsorship for Partner Migration
- Visa Application Charge
- 4 passport-size photographs
- Completed health examination at designated panel hospital
- Birth certificates for all members of your family unit (ie children) - whether or not they are applying to migrate to Australia with you. For Korean nationals, please provide the Family Relation Certificate and Identification Certificate. Your marriage certificate (if applicable),or for Korean nationals the Marriage Relation Certificate which shows your marital status.
- You and your sponsor's divorce certificates (if applicable)
- If you have lived in a country for a total period of 12 months during the last 10 years prior to the application, penal clearance from each country is required. Refer to Character requirements penal clearance certificates for information on obtaining penal clearance. For Korea, refer to Korea National Police Clearance.
See: Korea National Police Clearance - If your application includes children under 18 years of age, formal written consent from the non-migrating parent or legal guardian confirming that the child may migrate to Australia. The document must be certified by an authorised person or institution (ie notary public, Justice of the Peace).
- Evidence of Australian citizenship or Australian permanent residence of the sponsor (eg certified copy of Australian passport, Australian permanent resident visa, Australian citizenship certificate)
You need to provide evidence that the relationship between you and your partner is genuine and on-going. Examples might include:
- Evidence of communication with your sponsor, eg. telephone bills, letters, cards.
- Statutory declarations from family members and friends and/or employer and/or other persons confirming your relationship.
- A written statement outlining the history of your relationship with your sponsor (eg when and how you met, when you started living together, joint activities, significant events in the relationship etc.).
- Photographs, accompanied by photocopies and a description of the photograph, such as place, date and the names of those people who are in the photograph. Original photos, letters, etc will be returned to you upon finalisation of your application.
